ZBA Application Guide
This guide is intended to help you through the application process only.

The applicant shall meet with the Building Inspector (498-2901 Ext. 22). He will
determine if you need a special permit or variance. The applicant should provide
a sketch of the plan with distances to abutting property lines and street boundaries
(if building construction is planned). The applicant should provide a description
of the business if it is to be conducted in an existing building.

If the applicant is not the owner, the applicant must provide a notarized letter
of approval/consent signed by the owner or authorized agent.

Applications are available at the Northfield Town Hall, in the main hallway.

For assistance the applicant may contact the Chair (Ed Shearer 498-2730), a member
of the ZBA or the Administrative Assistant (Vivien 863-2916) to answer questions
and verify the application is properly filled out.

The Applicant shall return the completed application to the Town Clerk. Upon
its return, the application will be date stamped by the Town Clerk, and no further changes or adjustments can be made. A filing fee of $75.00 is required.

The Assessor's Office, 498-2901 Ext. 18, can assist the applicant with information
to fill out the application. They can provide you with the "Map and Lot" number,
lot size/frontage information, Deed Information and an abutter's list (The abutter's
list is to be used for the Certified/Return Receipt Mail. An Information Form
Request Form is attached)

The applicant shall include the following with the application: a.) a scale drawing
of the premises showing distances from any buildings, or proposed buildings, to
all property lines, b.) a scale drawing of any changes to the building interiors
and c.) if the applicant is not the owner, the applicant must provide a copy of a lease or rental agreement with the owner of the property.

The applicant will be contacted by the Chairman or Administrative Assistant for
the Zoning Board of Appeals (ZBA) to set up the public hearing date and time.
The Administrative Assistant will prepare the legal notice to be posted and published
twice in a local newspaper and will a furnish copy of the notice to the applicant.
The applicant is responsible for mailing to the abutters the date and time of
the Public Hearing (including a copy of the public hearing notice) by Certified/Return
Receipt Mail.

The Applicant must bring the Return Receipt Cards to the public hearing. (The
hearing cannot go forward without them.) The Chair will ask for them during the
meeting.

To grant a VARIANCE an applicant/petitioner must establish that special conditions
exist affecting the parcel of land or building.

If the applicant would like to view a copy of the Northfield Zoning Bylaws, they
are available at the Dickinson Memorial Library, the Town Clerk's Office and the
Selectmen's Secretary's Office. If you wish to purchase a copy, the cost is $15.00
and is available at the Secretary's Office.

If a Special Permit or Variance is granted to the property, the property owner must file final paperwork with the Registry of Deeds for the Decision to be legal.

PETITION FOR A VARIANCE
Please consider that your proposal must not be a substantial detriment to the
public good and it must not nullify or substantially derogate from the intent
and purpose of the zoning ordinance bylaw.
Why/how does your petition qualify for a variance in relation to the following

Although each case should be analyzed on it's own merits, the Courts rarely uphold
the granting of a variance. The Courts have found most arguments related to hardship
do not support the granting of a variance.
